I. Introduction and Acceptance
These Terms of Service govern your use of the Teledris Health website located at teledris.com, the Teledris Health patient portal, and all related services provided by Teledris Health, operated by Teledris LLC, located at 8 The Green, STE 12393, Dover, DE 19901 (collectively, the “Platform”).
By accessing or using the Platform, submitting an intake, or receiving any services through Teledris Health, you agree to be bound by these Terms, our Privacy Policy, and our Notice of Privacy Practices. If you do not agree to these Terms, do not use the Platform or any of our services.
We reserve the right to update or modify these Terms at any time. Your continued use of the Platform following any changes constitutes acceptance of those changes.
II. Emergency Disclaimer
TELEDRIS HEALTH IS NOT AN EMERGENCY MEDICAL SERVICE.
IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL 911 OR GO TO YOUR NEAREST EMERGENCY ROOM IMMEDIATELY.
Teledris Health does not provide emergency medical care, urgent care services, or treatment for life-threatening conditions. Our Platform is designed for non-emergency telehealth consultations only. Do not use Teledris Health as a substitute for emergency medical services.
III. Eligibility
To use the Platform and receive services from Teledris Health, you must:
- Be at least 18 years of age.
- Be a resident of or physically located in a state where the Teledris Health program you are requesting is available at the time of your consultation. Program availability varies by state, and programs involving controlled substances are additionally limited to states where the treating clinician is licensed.
- Provide accurate, complete, and current information during intake and throughout your use of the Platform.
- Complete the identity verification described in Section IV before checkout.
- Not be using the Platform on behalf of another person unless authorized by Teledris Health.
By submitting an intake or using our services, you represent and warrant that you meet all of the above eligibility requirements.
One active treatment per program. You may enroll in more than one Teledris Health program at a time, but you may hold only one active treatment plan per program. If you attempt to start a second enrollment in a program where you already have an active or paid plan, we will decline the new intake and direct you to your existing plan rather than opening a duplicate.
IV. Identity Verification
Every patient must pass an identity check before checkout, for every program. This protects against fraudulent orders and is a condition of using the Services — you cannot complete an order without it.
What We Collect and Why
As the last step before payment, you are asked to submit a photograph of a government-issued photo ID and a self-portrait photograph of your face (a “selfie”). We transmit those images to our third-party identity-verification provider, which checks the authenticity of the identity document and confirms that the person in the selfie is the person shown on the document.
- Teledris Health does not store your ID or selfie images. They are held only for the duration of the check and transmitted to our identity-verification provider and, where a program requires it for the clinical record, to your treating clinician's platform.
- We do retain a record of the check itself: its outcome, our provider's reference identifier, the date and time, the document type and the name, date of birth, document number and expiration date read from your ID, the score and result of the facial comparison, and any risk warnings our provider returned. We keep this as the audit record that you were verified.
- If your identity cannot be verified, you are not charged, no authorization is captured, and no medication is dispensed. Any amount charged in error is refunded in full.
- Your identity-verification provider processes these images as our service provider, under its own retention and security practices.
Facial Comparison and Biometric Information
The check described above includes an automated comparison of your selfie against the portrait printed on your identity document. That comparison analyzes facial characteristics and may constitute the collection, use, or disclosure of biometric information or a biometric identifier under the laws of certain states.
By submitting your ID and selfie, you consent to Teledris Health and its identity-verification provider collecting and using your facial image and any facial-comparison data derived from it for the sole purpose of verifying your identity, preventing fraud, and satisfying our legal and clinical obligations. We do not sell this information, do not use it for advertising, and do not use it to identify you for any other purpose.
If you do not wish to have your facial image processed in this way, do not submit a selfie — but you will not be able to complete an order, because the check is required. To ask questions about this processing, or to request deletion of the verification record we retain, contact support@teledris.com.
V. Account Registration and Security
To access certain features of the Platform, you must create an account. When you register, you agree to:
- Provide truthful, accurate, and complete information, including your legal name, date of birth, contact information, and medical history.
- Maintain and promptly update your account information to keep it accurate and current.
- Maintain the confidentiality of your account credentials and not share your password with any third party.
- Notify us immediately of any unauthorized use of your account.
You are solely responsible for all activity that occurs under your account. Teledris Health is not liable for any loss or damage arising from your failure to safeguard your account credentials.
We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, provided false information, or engaged in conduct that is harmful to Teledris Health, other users, or our clinical service partners.
VI. Description of Services
Teledris Health is a technology platform that connects patients with licensed healthcare providers for non-emergency telehealth consultations. Our current service offerings include, but are not limited to:
- GLP-1 Weight Loss Treatment — Consultations for compounded semaglutide, tirzepatide, and related GLP-1 receptor agonist medications for weight management.
- Testosterone Replacement Therapy (TRT) — Consultations for testosterone replacement therapy for qualifying patients. Testosterone is a controlled substance; these consultations involve additional requirements, including laboratory testing and, where required, a live video visit.
- Sexual Health — Consultations for erectile dysfunction and related medications, including compounded formulations.
- Hair Regrowth — Consultations for hair loss treatments such as finasteride and minoxidil.
- Peptides & Longevity — Consultations for peptide and related therapies where clinically appropriate.
- Mental Health — Consultations for therapy and medication management.
- Women's Hormone Therapy — Consultations for perimenopause and menopause hormone support.
Not every program listed above is open for enrollment at any given time, and availability differs by state. Programs that are not yet open may offer a waitlist; joining a waitlist records your interest and contact details and does not create a clinical relationship, an order, or a charge.
How the Service Works
- Patient Intake: You complete a medical intake providing your health history, current medications, allergies, symptoms, and other relevant clinical information, and you select the treatment you are requesting.
- Identity Verification: You complete the identity check described in Section IV.
- Payment Authorization: You submit payment details. Depending on your program, we either place an authorization hold or securely save your card. In both cases, you are not charged before a clinician approves treatment — see Section X.
- Clinician Review:Your intake is reviewed by an independent licensed healthcare provider within the provider network facilitated by our telehealth services partner for your program. Reviews are typically completed within 24 hours but may take longer depending on volume and complexity. Your clinician may ask you for additional information before deciding — for example a photo of your driver's license, a short introductory video, an updated answer to a clinical question, additional documents, or your pharmacy preference. We will notify you when something is needed, and your case will not progress until you provide it.
- Clinical Decision: The reviewing provider determines, at their sole discretion, whether to prescribe medication based on your clinical profile. A prescription is not guaranteed.
- Prescription Fulfillment: If a prescription is issued, your clinical services partner transmits it to a licensed partner pharmacy, including compounding pharmacies, which dispenses the medication and ships it directly to your address. We will keep you updated as your order is prepared, ships, and is delivered.
- Ongoing Care: Follow-up consultations, clinician messaging, and monitoring are provided as part of your treatment plan, as described below.
Ongoing Care and Follow-Up Visits
Continuing treatment is not automatic. Before each new treatment cycle, we ask you to complete a short follow-up check-in so your clinician can confirm that continued treatment at the same dose remains appropriate. We notify you by email — and by SMS if you have opted in — when a follow-up is due.
- Each new cycle is reviewed by a clinician, and is charged only after that cycle is approved (see Section X).
- If you do not complete your follow-up, your treatment does not continue, no further medication is dispensed, and you are not charged for that cycle.
- Your clinician may change your dose, strength, or formulation at any follow-up, or may determine that continued treatment is no longer appropriate.
Laboratory Testing
Some programs require laboratory testing before or during treatment. Testosterone replacement therapy, in particular, generally requires bloodwork.
- Depending on your state and your clinician's order, testing is performed either by an at-home collection kit shipped to you, or in person at a patient service center or laboratory draw site.
- Where in-person collection is required — which is the case in some states because at-home collection is not available there — you may be required to travel to and appear physically at a laboratory. This is an exception to the otherwise remote nature of the Services.
- We notify you as your lab order progresses, including when a kit ships, when your sample is received, and when results are available.
- Where a laboratory requires a requisition form, it is made available to you through your patient portal, and you can upload lab results you obtained elsewhere for your clinician to review.
- Failing to complete required laboratory testing may delay or prevent treatment.
Video Visits
Some programs require or offer a live video visit with a clinician in addition to or instead of asynchronous review. Where a video visit applies to your care, we will notify you to schedule it and provide a booking link. You may reschedule. Missing a scheduled visit without rescheduling may delay or prevent treatment.
Automated Screening
Parts of your intake are evaluated automatically before a clinician sees them. Clinicians designate certain answers in advance as disqualifying for a given treatment on safety grounds. If you give such an answer, our system ends the visit at that point — before any payment is taken — and tells you that we cannot treat you through this program.
This automated screen is a safety guardrail, not a medical opinion about you, and it does not mean a clinician has reviewed your case. You are not charged when a visit ends this way. If you believe the screen reached the wrong result, contact support@teledris.com.
Important Service Limitations
- No guarantee of prescription. The decision to prescribe medication is at the sole discretion of the treating provider based on clinical judgment and applicable medical guidelines.
- Primarily remote care. Most Teledris Health consultations are conducted asynchronously — you submit information and a clinician reviews it without a live appointment. Some programs and states additionally require a live video visit, and some require in-person laboratory collection. We do not perform physical examinations, and certain conditions may require in-person evaluation we cannot provide.
- Controlled substances. Certain therapies (such as testosterone) involve controlled substances and are prescribed only where permitted under the federal Ryan Haight Act, U.S. Drug Enforcement Administration telemedicine rules, and applicable state law, which may require additional identity verification, laboratory testing, a live video visit, or an in-person evaluation.
- Not a replacement for primary care. We strongly recommend maintaining an ongoing relationship with a primary care provider.
VII. Telehealth Consent
By using Teledris Health services, you acknowledge and consent to the following:
- Your consultation will be conducted remotely rather than as an in-person office visit — in most cases asynchronously, by written intake and clinician review, and in some cases by live video visit.
- Telehealth has limitations, including the inability to perform a physical examination.
- Where your program requires laboratory testing, you may be required to use an at-home collection kit or to appear in person at a laboratory.
- The provider may determine that your condition is not appropriate for telehealth treatment and may decline to prescribe medication or refer you for in-person care.
- Technical disruptions may occur that could affect the delivery of services.
- Some of your answers are screened automatically for safety before a clinician reviews them, and that screen can end a visit before clinician review.
- You have the right to withdraw your consent to telehealth services at any time.
- Telehealth consultations are conducted in compliance with the telehealth laws of the state where you are located, including Florida Statute § 456.47 where applicable, and with applicable federal law.
Additional program-specific disclosures — including the risks of compounded GLP-1 therapy, monitoring expectations, and your responsibilities as a patient — are set out in our Informed Consent for Telehealth Services and Compounded Medication Treatment.
VIII. Clinical Provider Relationship
Healthcare services accessed through the Teledris Health Platform are provided by independently licensed healthcare providers affiliated with our clinical service partner networks. These providers include physicians, nurse practitioners, and physician assistants who are licensed in your state.
Teledris Health coordinates these services through one or more third-party telehealth technology and clinical-services partners. Which partner facilitates your care depends on your program and the medication involved:
- MD Integrations — our partner for programs that do not involve controlled substances, including GLP-1 weight management.
- Beluga Health — our partner for programs involving controlled substances, including testosterone replacement therapy.
Each partner operates telehealth infrastructure that connects you with its network of independently licensed clinicians and facilitates clinical review, prescribing, laboratory ordering where applicable, and pharmacy coordination. Neither partner itself practices medicine; medical care is rendered by the licensed clinicians described above. Your use of services facilitated by these partners may also be subject to their own terms of service. We may add, change, or replace clinical services partners, and we route each order to the partner appropriate for the medication involved.
You acknowledge and agree that:
- Teledris Health is a technology platform that facilitates access to healthcare services. Teledris Health itself does not practice medicine.
- The provider-patient relationship is established between you and the treating licensed provider, not between you and Teledris Health.
- Clinical decisions, including the decision to prescribe or not prescribe medication, are made solely by the treating provider in their independent medical judgment.
- Teledris Health does not interfere with, direct, or control the clinical judgment of any healthcare provider.
- Providers may be employed by or contracted through affiliated professional entities or through the provider networks of our clinical-services partners.
IX. Compounded Medications
Certain medications prescribed through Teledris Health may be compounded by a licensed compounding pharmacy. By using our services, you acknowledge and agree to the following:
- Compounded medications are not FDA-approved. They are prepared by state-licensed pharmacies pursuant to a valid prescription from a licensed provider but have not undergone FDA review for safety, efficacy, or manufacturing quality.
- Compounded medications are prepared individually or in small batches and may differ from commercially manufactured products.
- You are responsible for informing your provider of any known allergies to medication ingredients or compounds.
- The availability and formulation of compounded medications may change based on regulatory guidance, ingredient availability, or pharmacy discretion.
- Teledris Health does not manufacture, compound, or dispense any medications. All medications are dispensed by independent licensed pharmacies.
X. Payment Terms
Pricing and Fees
By purchasing a treatment plan through Teledris Health, you agree to pay the fees associated with your selected service as displayed on the Platform at the time of purchase. All fees are in U.S. dollars.
For our cash-pay programs, the price shown is for your medication plan and includes clinical review, provider messaging, and shipping at no additional charge. We do not bill a separate consultation fee. Pricing varies by service and treatment plan.
Clinician Adjustments to Your Plan
Your clinician may prescribe a different strength, dose, or formulation than the one you selected at checkout. When that happens:
- You are never charged more than the amount you authorized at checkout. If your clinician prescribes a plan that would cost more, we do not charge you the difference.
- Where your plan is billed by authorization hold, we capture only the price of the plan your clinician approved — so if it costs less than you authorized, you are charged the lower amount.
- Where your first cycle is billed by invoice, that cycle is billed at the amount shown to you at checkout.
- The same ceiling applies to each ongoing cycle: the amount you authorize for a cycle is the maximum you can be charged for that cycle.
Saved Payment Methods
When you check out, your payment card is saved by Stripe for future use on your account. We do so in order to:
- Charge your approved treatment if your authorization hold expires before clinical review completes;
- Bill your ongoing treatment cycles after each cycle is approved; and
- Allow you to enroll in an additional Teledris Health program without re-entering your card, by billing that program to the same payment profile.
Teledris Health never receives or stores your full card number. You can add and remove saved cards yourself in your patient portal, or contact support@teledris.com. Removing a saved card does not cancel your plan — if you remove the card your plan bills to, your next cycle's charge will fail rather than your treatment stopping cleanly. To end a plan, cancel it as described below.
Ongoing Cycles and Recurring Charges
Most treatment plans continue in recurring cycles — for example a new medication shipment every four weeks — until you cancel. If you enroll in a recurring plan:
- Your plan automatically renews at the then-current price and billing interval until you cancel. We obtain your affirmative consent to these subscription terms at checkout, disclose the recurring amount and frequency before you are charged, and send any notices required by applicable automatic-renewal laws.
- You authorize recurring charges to your saved payment method at the frequency specified at the time of enrollment.
- Each cycle requires a follow-up check-in and clinician approval before it is billed (see Section VI). A cycle you do not complete a follow-up for is not shipped and not charged.
- We notify you by email — and by SMS if you have opted in — when a follow-up is due for your next cycle.
- Your plan continues at the then-current price for your prescribed treatment, subject to the authorization ceiling described above, until you cancel.
- Charges are processed automatically once a cycle is approved, unless you cancel before that cycle is billed.
- You may cancel at any time from your patient portal, or by contacting us at support@teledris.com.
Cancellation and Refunds
- Before clinician approval: Your card is only authorized or saved, not charged. If you cancel before a clinician approves your treatment — or if a clinician determines treatment is not appropriate for you — the hold is released or the invoice is voided, and you are not charged.
- After approval, before shipment: Once a clinician approves your treatment and your card is charged, you may request a refund of the medication cost any time before your medication ships.
- After medication shipment: Once your medication has shipped, it is non-refundable, because compounded medications are prepared specifically for you and cannot be returned or reused.
- Cancelling a recurring plan: Cancellation stops future cycles. A cycle that has already been approved and charged is not reversed by cancelling, and we do not prorate or refund partial billing periods.
Our Refund Policy sets out these rules in full, including damaged, lost, or misshipped orders. To request a cancellation or refund, contact support@teledris.com.
XI. Communications
By creating an account, you agree to Teledris Health’s Terms and acknowledge our Privacy Policy. Creating an account or providing a phone number does not automatically enroll you in SMS/text messages. You may separately opt in to receive communications by SMS/text where offered.
What We Send You
We send messages that are necessary to deliver your care and operate your account. These include:
- Sign-in links and one-time codes needed to access your account and portal.
- Requests for information your clinician needs before deciding — for example a photo of your driver's license, a short introductory video, an updated clinical answer, additional documents, or your pharmacy preference.
- Clinical status updates, including when your case is assigned to a clinician, when your clinician is waiting on you, when your treatment is being processed, when a prescription is written, and when your visit is complete.
- Order and shipping updates, including when your order is in fulfillment, in transit, out for delivery, delivered, or has a delivery problem.
- Laboratory updates, including when a collection kit ships or is delivered, when your sample is shipped or received, and when results are available.
- Video visit updates, including when a visit is ready to schedule, is scheduled, is rescheduled, or was missed.
- Follow-up reminders when a new treatment cycle is due.
- Messages sent to you by your clinician or our support team.
- Account, billing, and service notices, and — where you have not opted out — promotional materials.
Messages about your care and your account are transactional and are sent regardless of marketing preferences, because they are necessary to provide the Services you requested. We may also contact you by telephone about your treatment or account.
SMS/Text Messages
If you opt in, Teledris Health may send recurring and non-recurring SMS/text messages to the mobile number you provide for the care-related and account purposes described above, including clinician requests for information, action-required clinical status updates, follow-up reminders, appointment scheduling and reminders, care coordination, and account notifications. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. Consent to receive SMS is not required to create an account, make a purchase, or receive healthcare services.
Patient Portal Messaging
Your patient portal includes a message thread with your care team. Messages you exchange there with clinicians and support staff form part of your record, are retained with your case, and may be reviewed by the clinicians and clinical-services partners involved in your care. Do not use portal messaging for emergencies — see Section II.
Opting Out
You may opt out of marketing emails by using the unsubscribe link. You may opt out of SMS/text messages at any time by replying STOP. After you opt out of SMS, Teledris Health may contact you through other available channels for important account, transactional, or care-related communications. You cannot opt out of the transactional and care-related messages needed to deliver treatment while you have an active plan; if you no longer wish to receive them, cancel your plan.
XII. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
- Provide false, inaccurate, or misleading health information in your intake form or communications with providers.
- Submit an identity document or photograph that is not your own, or otherwise attempt to defeat the identity verification described in Section IV.
- Attempt to obtain medications for which you are not clinically eligible or to circumvent clinical screening processes.
- Impersonate any person or entity, or misrepresent your identity or affiliation.
- Use the Platform to seek controlled substances for purposes other than legitimate medical use.
- Interfere with or disrupt the Platform, servers, or networks connected to the Platform.
- Attempt to gain unauthorized access to any part of the Platform, other accounts, or computer systems.
- Use any automated system, including bots, scrapers, or crawlers, to access or interact with the Platform.
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform without express written permission.
- Harass, abuse, or harm Teledris Health staff, healthcare providers, or other users.
Violation of these prohibitions may result in immediate suspension or termination of your account and may be reported to law enforcement or regulatory authorities.
XIII. Intellectual Property
All content on the Platform, including text, graphics, logos, images, software, and the compilation thereof, is the property of Teledris Health or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
The Teledris Health name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Teledris Health or its affiliates. You may not use such marks without our prior written permission.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use, subject to these Terms.
XIV. Privacy and HIPAA
Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms.
Our use and disclosure of your protected health information is governed by our Notice of Privacy Practices, which describes your rights under HIPAA and how your PHI may be used and disclosed in connection with healthcare services.
To deliver the Services we share information with service providers and partners, including our clinical-services partners and their clinician networks, partner pharmacies, laboratories, our identity-verification provider, our payment processor, and the platforms we use to email and text you. Section IV describes the facial-comparison processing performed as part of identity verification.
By using the Platform, you acknowledge that you have received and reviewed our Privacy Policy and Notice of Privacy Practices.
XV. Disclaimer of Warranties
THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TELEDRIS HEALTH DOES NOT WARRANT THAT:
- The Platform will be uninterrupted, secure, or error-free.
- The results obtained from the use of the Platform will be accurate or reliable.
- Any defects in the Platform will be corrected.
- The Platform is free of viruses or other harmful components.
Teledris Health does not guarantee any specific clinical outcome from the use of our services. Medical treatment results vary based on individual factors and are not guaranteed.
XVI. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TELEDRIS HEALTH, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR CLINICAL SERVICE PARTNERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES.
This includes, but is not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with:
- Your use of or inability to use the Platform or services.
- Any conduct or content of any third party on the Platform.
- Any content obtained from the Platform.
- Unauthorized access, use, or alteration of your transmissions or content.
IN NO EVENT SHALL TELEDRIS HEALTH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE AMOUNT YOU PAID TO TELEDRIS HEALTH IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you. Nothing in these Terms limits or excludes liability for personal injury or death caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under applicable law. These limitations do not apply to the independent professional liability of the treating clinicians for the medical care they provide.
XVII. Indemnification
You agree to indemnify, defend, and hold harmless Teledris Health, its officers, directors, employees, agents, affiliates, and clinical service partners from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with:
- Your use of the Platform or services.
- Your violation of these Terms.
- Your violation of any applicable law or regulation.
- Any information you provide through the Platform, including false or misleading health information.
- Any claim by a third party arising out of your use of the Platform.
XVIII. Dispute Resolution and Arbitration
Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact Teledris Health at support@teledris.com and attempt to resolve the dispute informally for at least thirty days.
Binding Arbitration
This arbitration agreement is governed by the Federal Arbitration Act. If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules, rather than in court.
Arbitration shall take place in Miami-Dade County, Florida, or at another mutually agreed location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver
YOU AND TELEDRIS HEALTH AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Your Right to Opt Out of Arbitration
You may opt out of this arbitration agreement and class action waiver within thirty days of first accepting these Terms by sending written notice of your decision to opt out to support@teledris.com with your name and the email associated with your account. If you opt out, neither party will be required to arbitrate, and this Section will not apply.
Exceptions
Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction for claims relating to intellectual property infringement or misappropriation. Nothing in this Section waives any right to seek public injunctive relief to the extent such a waiver is prohibited by applicable law, including under California law.
XIX. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of such courts.
XX. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
XXI. Entire Agreement
These Terms, together with the Privacy Policy and Notice of Privacy Practices, constitute the entire agreement between you and Teledris Health regarding your use of the Platform and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.
